May someone track me via AirTag or GPS tracker?
No. Covertly tracking someone without consent is stalking (Sr Art. 285b) — punishable up to 3 years prison. Found a hidden tracker? File a police report.
Hiding an AirTag, Tile, Samsung SmartTag, or GPS tracker on or in someone's belongings to follow them is a crime in the Netherlands under stalking (Sr Art. 285b, max 3 years). Apple and Google added built-in anti-stalking alerts in 2024: your iPhone or Android device automatically warns when an unknown AirTag/SmartTag is following you. Three scenarios: (1) Ex or partner hides tracker — criminal + DV context. Call Veilig Thuis (0800-2000), police, and Slachtofferhulp immediately. (2) Employer tracks without works-council consent — unlawful + AP complaint. (3) Anti-theft — someone "accidentally" placed a tracker in your belongings to recover stolen items — possible under conditions, but must be disclosed immediately once recovered. Found a hidden tracker? Don't disassemble — preserve evidence. Screenshot the iPhone/Android alert. Bring to police station. File a report. Hand over tracker for investigation. Civil action: civil injunction for cease-and-desist + Art. 82 GDPR damages claim possible on demonstrable damage.
