See our extensive article may-private-detective-follow. Only licensed firms (WPBR) + legitimate purpose + only public locations.
See our extensive article may-private-detective-follow. Core in 3 points: (1) WPBR licence required — detective must be a Dutch Ministry of Justice licensed investigation bureau. Unauthorised "surveillance" = stalking criminal (Sr 285b). (2) Legitimate interest + assignment from party with stake — employer on theft suspicion, insurer on fraud, separated parent on child abduction. Not "just in case". (3) Only public locations + careful with private domain. Home intrusion or hacking accounts = criminal. Since 2024: drone surveillance + tracker installation (like AirTag) is explicitly expanded under Sr Art. 285b. PI may only do this under strict conditions + DPIA. What to do on suspicion: GDPR Art. 15 access request at suspected commissioner — ask if investigation is running + by whom. On refusal: AP complaint. On suspected unauthorised activity: police + civil damages claim Art. 82.
