Can my landlord refuse sustainability or label upgrades?

In social rent: no — labels E/F/G expose landlord to WWS point loss. In free sector: contract-driven. Route explained.

In social rent: label E/F/G means lower WWS points and lower max rent. Since 2023 social landlords may not regular-rent E/F/G — mandatory upgrade. Tenant can request upgrade (BW 7:243 + EPV Act) with 70% co-tenant agreement — landlord can refuse but must justify (technically infeasible or disproportionately expensive). Refusal without valid reason: Rent Tribunal. Free sector: contract freedom but refusal can ground court action on well-substantiated technical need (BW 7:206 — landlord must ensure "proper enjoyment"). From 2026: prohibition on free-sector F/G rent — landlord must upgrade first. As tenant: written request + receipt confirmation + cite statutory prohibitions.
