What happens to an energy contract on death — can the supplier keep billing?

On death the personal contract ends by operation of law. Heirs may choose: continue, terminate, or sign a new contract. We explain the steps.

On the contract holder's death the energy contract ends automatically per death date (BW art. 7:5 + standard terms). Heirs or executor must notify the supplier as soon as possible + supply end reading. Three options:

  1. continue in heir's nameusually possible within 30 days with no termination fee
  2. terminate per death datefinal statement with reading at date of death
  3. vacancy (unoccupied)temporarily lower advance, fixed fees continue. NOT allowed: continued billing in the deceased's name AFTER date of death — that's a debt without legal ground. Terminate in writing with a copy of the death certificate; final statement within 6 weeks to the heir's IBAN.
