What are the rules for the CCTV information sign? (GDPR Art. 13)
Mandatory visible at every camera. Must state: filming occurs, who is responsible, contact route, and purpose. Reference to extended info (privacy statement) required.
At every camera you must provide transparency to those filmed — GDPR Art. 13 + AP CCTV guideline. A "CCTV sign" at the entrance is the minimum requirement. Required info on the sign: (1) Symbol/icon indicating "camera surveillance". (2) Text: business name + that filming occurs. (3) Purpose — e.g. "for security" or "for theft prevention". (4) Contact details of controller + (if any) DPO. (5) Reference to extended info (privacy statement URL or QR code). What is NOT sufficient? Only a camera symbol without text. Only "CCTV surveillance" without controller. Sign hidden behind a bush. Location: at every entrance of the filmed area, at eye height, sufficiently lit. Specific rules: shops (AP CCTV guideline), public space municipality (Municipalities Act 151c — stricter), homes (no required sign, but yes if you film public space). On violation: AP fine, demand to remove camera, damages claim from filmed persons who didn't know they were filmed. Example 2024: AP fine €30k for restaurant without visible sign — all footage from period must be destroyed.
