May I install a camera outside my shop?
Yes for security of own premises, provided aimed at own area, signs at entrance, max 4 weeks retention, no filming public street.
Shop owner may install cameras for theft prevention + employee safety, under conditions. Requirements: (1) Concrete purpose — security, not "just in case". (2) Aimed at own premises — checkout area, own shop floor. NOT on public street (municipal authority via Municipalities Act 151c). (3) Clear signs at every entrance ("CCTV in operation — [shop name]") + privacy info available. (4) Retention max 4 weeks (AP guideline; longer only on concrete incident + concrete evidence value). (5) No audio — strictly prohibited unless specific basis. (6) No changing or staff rooms — Sr 139f forbidden zone. (7) Privacy statement on website + at entrance. What is NOT allowed? Camera right above checkout aimed at customer PIN (= capturing financial data). Camera on street for "marketing analysis" of foot traffic. Camera on competitor. Camera on adjacent home entrance. Staff monitoring: separate rules — works council consent + DPIA required (see also employee monitoring). On overstepping: AP complaint for customer or employee. Fines 2024 for restaurants/shops without clear signs: €30k-€100k.
