May my health insurer request my medical record?

See our article insurer-medical-record. Only via medical adviser, only what strictly needed for claim, your consent required.

Last reviewed: 25 May 2026
See our extensive article insurer-medical-record. Core: health insurer may see claim data (DBC codes, treatment dates) — but NOT the full record without consent. Statutory regulation: Dutch Healthcare Market Act + Dutch Healthcare Data Act + GDPR Art. 9. Regular insurer employee = no access to record content. Only medical adviser (BIG-registered, professional secrecy) may request relevant parts on claim investigation — via care provider, with your consent, strictly limited. What is NOT allowed: full record copy without concrete claim, premium adjustment based on record content (prohibited — Wmg anti-discrimination), sharing with re-insurer without basis, marketing use. On overstepping: Kifid complaint (financial aspect) + AP complaint (GDPR) + IGJ (healthcare aspect). AP fine 2024: health insurer €500k for systematic record-reading without basis.
