May my employer read my WhatsApp?

On your private phone: never without explicit consent. On a work phone: only under very strict conditions (proportionality, works-council consent, prior announcement).

Employers often want to read WhatsApp — especially on suspicion of misconduct or data leaks. Private phone: never. It's your property, your account, your correspondence. Accessing without consent is computer trespass (Sr Art. 138ab) + GDPR violation. Work phone: theoretically possible, but very strict: (a) works-council consent required for monitoring policy (Dutch Works Council Act Art. 27(1)(k)), (b) prior announcement in the employee handbook, (c) proportionality — only where less intrusive means are impossible, (d) concrete suspicion, not "just in case". Private messages on work phone: remain protected by ECHR Art. 8 (Bărbulescu v Romania 2017, ECtHR Grand Chamber). Employer may view business messages but must leave private messages unread. What to do if exceeded? (1) Immediately stop using work phone for private. (2) Request access Art. 15 to see what they've processed. (3) Complaint to works council + employer. (4) AP complaint for GDPR aspect. (5) Termination based on this: cantonal judge — unlawfully obtained evidence can lead to annulment of termination + damages. Tip: the Dutch Telecoms Act (Art. 18.13) provides extra protection for communication content — often forgotten by employers.
