Do I need a permit for a dormer (dakkapel) in the Netherlands?
At the BACK of the house (not visible from public road), a dormer is permit-free if it's less than 1.75m high, sits at least 0.5m from the roof edge, and doesn't fundamentally alter the facade. At the front: always apply for an environment permit (welstand review required). Protected cityscape (Amsterdam centre, canal belt) or monument (national or municipal): always permit required, also at the back. For apartments: VvE (homeowners' association) approval separate from permit. When in doubt: do the free check at omgevingsloket.nl (30 min). Fine for unpermitted construction: €1,500–5,000 plus possible removal order.
📋 The rules
- Back side permit-free: dormer <1.75m high and at ≥0.5m from roof edge
- No reduction of existing roof surface by >50%
- In row houses: no unreasonable nuisance to neighbours (view, shadow)
- Front side: always environment permit (welstand assessment required)
- Corner dormer: permit required if visible from public road
- Protected cityscape (Amsterdam centre, canal belt, etc.): always permit
- Monuments (national or municipal monument): always permit + monument committee
- Apartment with VvE: VvE approval always required, separate from permit
- Social housing: landlord must give written permission, regardless of rules
🔓 Exceptions
- Energy saving (solar panels on flat roof): often also permit-free
- Replacement of existing dormer with same dimensions: usually permit-free
- Temporary roof window (Velux-type) <0.5m×0.5m: not a dormer, no permit
- Detached house on large plot (>500m²): sometimes more lenient rules
⚠️ Penalty if you do it anyway
€1,500–5,000 for construction without permit (depending on municipality and size). Municipality can require dormer removal (fine €500–5,000 per week or administrative coercion). House sale later: buyer can require permit or legalisation before transfer. Mortgage: banks often require valid building permit — missing permit can block financing.

❓ Frequently asked questions
What if my neighbour has built an unpermitted dormer?
You can file an enforcement request with the municipality. If the construction required a permit, the neighbour must either apply (legalise) or remove the dormer. For improper damage to your home (leaking, cracks): civil claim possible.
Is a permit expensive?
Amsterdam environment permit: fees €500–2,000 depending on construction sum (often 3% of building costs, minimum €500). For permit-free construction: no costs. Architect drawing for application: €500–1,500 extra. Welstand assessment: free as part of permit.
How long does a permit application take?
Regular procedure: 8 weeks. Extended procedure (for neighbour objections or complex construction): 26 weeks. Permit-free: 0 days, just start. Tip: file a preliminary request first (free) to informally test whether permit is feasible.
Can I start before the permit is granted?
No, even if you know it will be granted. Construction without permit: legalisation permit + fine (€1,500+). For construction that cannot be permitted: mandatory removal plus fine. With apartment VvE: building without VvE approval = grounds for legal procedure.
What's the difference between a dormer and a roof extension?
Dormer: extension in roof surface for extra light + space in attic, stays within existing roof pitch. Roof extension: entire new floor on top of existing roof. Roof extension is much more invasive, always permit required, often structural calculation needed.
Can I build a dormer in a rented home?
Only with written permission from your landlord. Social housing: almost always refused. Free-sector: only with long-term lease and if renovation adds value. On departure you must restore original state, unless otherwise agreed.
Does a dormer affect the WOZ value of my house?
Yes. A dormer increases gross floor area and therefore WOZ value, usually by €15,000–40,000. The municipality updates this after first valuation after construction. On sale: most banks/agents reckon +€25,000–50,000 market value for a good attic dormer.
My neighbour objects to my dormer permit. What now?
Objection procedure takes 6 weeks after permit issuance. Neighbours can object on grounds such as view loss, shadow, privacy. On grant: permit can be revoked or amended. For long-running neighbour conflicts: Bij Wie? for housing issues (or beterburen.nl for mediation).
