🚨 What now? privacy problems

Someone wrote an unfair review about me or my business — what now?

Platform takedown via "report". On defamation: civil rectification or damages claim. Businesses: also consumer law + Cruijff jurisprudence portrait law.

Last reviewed: 25 May 2026
Unfair/incorrect reviews are a known problem for businesses and individuals. Two separate tracks: (A) False facts — e.g. "they steal money" without evidence. Defamation (Sr Art. 261) or libel (Art. 262). Criminal + civil. (B) Opinion — e.g. "service was bad". Freedom of expression + most platforms allow this. Hard to remove. Routes: (1) Platform report — Google Reviews, TripAdvisor, Trustpilot, Booking.com have "Report" button. Show: non-factual, abusive, deceptive. Platform decision in 7-14 days. (2) Direct contact with reviewer: often a misunderstanding. Ask for rectification or removal. (3) On defamation: police report + civil rectification claim + damages (Dutch Civil Code 6:162 tort). For businesses: ACM report on fake-review system. (4) On name publication: portrait right claim if photo + name. (5) GDPR route: your name in a review = personal data. Request erasure at platform under Art. 17. For businesses specifically: always respond professionally to reviews — other viewers appreciate transparency. Avoid combative response. On fake-review system (competitors paying for 1-star reviews): ACM reporting form.
