A business keeps calling me — what now?

Cold calls prohibited without prior consent since 1 July 2021 (Dutch Telecoms Act 11.7). On continued calling: ACM report (€50k-€900k fine per violation).

Telemarketing without prior consent is unlawful in NL since 1 July 2021 — opt-in regime (Tw Art. 11.7). Before that was Bel-me-niet Register (see article). Three steps: (1) State clearly on phone: "I do not want to be called again. This call is being recorded." Confirm afterwards in writing by email. (2) Keep evidence — date, time, number, content. (3) On continuation: ACM report via acm.nl + AP complaint. ACM enforcement 2023-2025: multiple businesses fined (€50k-€900k). Energy sellers, telecom providers, and health insurers are frequent targets. Spoof numbers + scam questions? Often fraud — not marketing. Hang up + Fraudehelpdesk + police if financial intent.

Step by step

  1. Refuse clearly + confirm

    On phone + in writing. "I don't want to be called by [business name] again."

  2. Collect evidence

    Date + time + number + content of each follow-up call.

  3. ACM report + AP complaint

    Online acm.nl reporting form — fines up to €900k per violation possible.
