Can the HOA block my solar panels or heat pump?
HOA can block on shared elements (roof, façade). Requires 2/3 majority. Sustainability-decision rules relaxed since 2022.
Solar panels on shared roof require HOA approval (model regulation art. 22 + BW 5:121 et seq.). Standard: simple majority for maintenance, 2/3 for changes to shared property. Since 2022 (BW 5:127a amendment) sustainability-measure threshold lowered to 50%+1 for: PV, shared heat pump, insulation. Decision at general meeting, ≥14-day notice with agenda. Individual solar on YOUR own balcony or roof terrace: ALWAYS allowed without HOA approval, within standard appearance rules. On refusal: request written reasoning + proof of statutes-compliant decision; on doubt civil court (BW 5:124 — request annulment of unreasonable decision). For deed-of-division with ban: annulment possible if unreasonably strict (recent case law).
