May my landlord request my income + employer statement?
Yes under proportionality norm. For social/mid-rent fixed rules. For free sector: excessive demands (3x net rent statements) often unlawful.
See also our extensive article landlord-pay-slip. Core: income check = legitimate for "contract performance" (GDPR Art. 6(1)(b)). BUT: data minimisation (Art. 5(1)(c)) requires proportionality. Social rent: statutory income threshold — landlord must prove annual income. Tax return suffices. Mid-rent: fixed norm annual income + rent price. Employer statement + pay slip standard. Free sector: grey area. Some landlords demand 3x gross rent as net income + 6 months bank statements — often excessive. What is allowed? Recent pay slip (1-3 months, BSN redacted), employment contract (only contract type + salary part, other clauses redacted), employer statement (typically via Aedes template). NOT: full bank statements (only relevant balance confirmation), BSN, marital status, children, religion, medical data, original passport copy without redaction. Retention: rejected candidates max 4 weeks (NVP). Accepted tenant = contract duration + 2 years. On suspected violation: Aedes (social rent) / NVM (free sector) complaint + AP complaint.
