Service costs or VvE fee too high — what do I do?
Service cost/VvE disputes: TENANTS: (1) Service cost statement annually from landlord mandatory (BW 7:259). Not received before 1 July? Demand registered. (2) Too high service costs: Huurcommissie procedure within 30 months. €25 (refund on win). Tests per cost: cleaning, gardener, energy common areas, lift, manager. Often 20-50% reduction granted. (3) Advance payments: reasonable ratio to actual. Too high advance = refund right. OWNERS VvE: (4) VvE fee: set in general meeting (annual). Key: share in division deed. (5) Object decision: within 6 weeks of meeting at county court. €87 (low) or €541 (normal). For procedural errors (notice too short, no quorum) or contrary to deed. (6) Reserve fund mandatory since 2018: 0.5% rebuild value or per VvE-MJOP. Non-compliance = court compels. (7) Amend deed: heavy — all owners + notary. Usually impossible in normal conflict. (8) Complaints: Vereniging Eigen Huis (member €126/yr) + Vereniging van VvE Belangenbehartigers. What DOESN'T work: refusing to pay — leads to collection + costs. First procedure, then temporary refusal.
